These Terms of Service ("Terms") are a legal agreement between you ("you", "the user") and Pit Helper, operated by Denys Tantsiura (sole operator), Ukraine ("Pit Helper", "we", "us"). They govern your access to and use of the Pit Helper website, web application and demo (together, the "Service"). By creating an account, activating a licence, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Pit Helper is a web-based decision-support tool for endurance-karting teams. It connects to third-party live-timing feeds, rates karts, forecasts pit windows, tracks net standings and helps a team coordinate pit stops on a shared screen. Pit Helper provides information and suggestions only. It does not drive, control the race, or guarantee any sporting result. All racing and strategy decisions are made by you.
You must be at least 18 years old (or the age of majority where you live) and able to enter into a binding contract. If you use the Service on behalf of a team or organisation, you confirm you are authorised to accept these Terms for it, and "you" includes that team or organisation.
We offer a free demo so you can try the Service. The demo runs on sample and local data, may limit or lock certain features, and is provided "as is" without any warranty or commitment. We may change or withdraw the demo at any time.
If you are a consumer in the EU/EEA, you normally have a 14-day right of withdrawal for digital services. Because our licences give you immediate access to the Service, by activating a licence you expressly request that we start providing it right away and you acknowledge that you lose your right of withdrawal once the Service has been fully performed, and that for partial performance you may owe an amount proportional to what you have used.
Nothing here removes mandatory consumer rights you have under the law of your country.
When using the Service, you agree not to:
Pit Helper connects to third-party live-timing providers (such as Apex Timing) and other services. We are not affiliated with, endorsed by, or responsible for those providers. Your use of their data is subject to their terms, and you are responsible for having the right to access the feeds you connect. Timing data can be delayed, incomplete or wrong, and our ratings and forecasts depend on it — so we cannot guarantee their accuracy.
The Service, including its software, design, models, text and branding, is owned by Pit Helper and protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own team's racing while your licence is valid. All rights not expressly granted are reserved. The race and team data you enter remains yours; you grant us the limited right to process it to run the Service.
Ratings, forecasts and pit suggestions are estimates based on incomplete, third-party and fast-changing data. They can be wrong. You are solely responsible for your racing, strategy and safety decisions and for complying with the rules of your event. Do not rely on the Service as your only source of information.
To the maximum extent permitted by law:
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law — for example liability for death or personal injury caused by negligence, for fraud, or your mandatory rights as a consumer.
You agree to cover reasonable losses we suffer that arise from your breach of these Terms, your misuse of the Service, or your infringement of a third party's rights (including a timing provider's terms).
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. We may also discontinue the Service or any feature; if we discontinue a paid feature you have already paid for, we will offer a pro-rata refund for the unused period where the law requires it. Sections that by their nature should survive (for example intellectual property, disclaimers, liability and governing law) continue after termination.
We may update the Service and these Terms as the product and the law evolve. We will change the "Last updated" date and, for significant changes, take reasonable steps to notify you. Continuing to use the Service after a change means you accept the updated Terms. If you do not accept them, stop using the Service.
These Terms are governed by the laws of Ukraine, without prejudice to the mandatory consumer-protection rules of the country where you live if you are a consumer. We would like to resolve any dispute directly first — please contact us. Consumers in the EU may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
